Conditions and Terms for the use of Smartplan
General
When creating an account at Smartplan.dk the following Terms and Conditions are accepted between the supplier (Smartplan) and the account owner (Customer). Smartplan is owned and delivered by:

Smartplan reserves the right to change and update the Terms and Conditions without warning. This includes the above noted ownership, which can change at any time without the consent of the Customer. The latest version of these Terms & Conditions is accessible at all times at https://smartplanapp.com/terms.
In the event of any breach of the Terms & Conditions noted below, Smartplan reserves the right to delete the Customer account and all information that might belong to the account.
General Conditions
- The customer must provide a valid email address and full name when registering.
- The customer is responsible for the safety of his/her account. It is the Customer's responsibility to protect and maintain his/her password and invitation code. Smartplan cannot be held responsible for what happens with the Customer's account and information. The customer is responsible for all content posted on the Smartplan account. The content must not be of an illegal nature.
- Smartplan cannot be held responsible for either direct or indirect mistakes made by the Customer. Including mistakes occurring due to the use of Smartplan. It is the Customer's own responsibility to ensure correct information in the rosters in Smartplan. Smartplan cannot be held responsible for errors in rosters or other content on Smartplan. The Customer's claim for compensation against Smartplan may under no circumstances exceed the sum of payments by the Customer over the preceding 6 months' services. The same applies in the event of a breach of personal data security or processing, for which the Customer is responsible and which has been carried out by Smartplan. If a registered person makes a direct claim for compensation against Smartplan, Smartplan also has the right to seek ongoing reimbursement for the costs of any kind associated with such a claim, so that Smartplan in no case pays compensation to a greater extent than stated.
- Smartplan may at any time update and change the Smartplan application. Smartplan may be unavailable during updates, but Smartplan strives to minimize any downtime during updates of Smartplan.
- Smartplan is designed to create rosters and manage rosters. If Smartplan is not used appropriately and we suspect abuse, Smartplan reserves the right to delete and block the Customer.
- Smartplan reserves the right to demand payment for any support to the Data Controller under the Data Processing Agreement at a set hourly rate of EUR 200 excluding VAT.
Conditions for Payment and Subscription
- All prices are in the shown currency on smartplanapp.com exclusive of VAT. Smartplan may adjust prices in relation to exchange rates, net price indices, charges and the like, so that Smartplan remains unaffected.
- A valid and supported credit/debit card is required to use Smartplan beyond the free trial period.
- You may try Smartplan for free for up to 30 days. At the end of the trial period, Smartplan will ask the customer to choose a subscription plan and fill in card details. Subsequently, the subscription begins.
- The subscription runs for 30 days at a time and is automatically renewed with prepayment of the coming period.
- At the commencement of the subscription, the Customer automatically grants Smartplan the right to withdraw the subscription amount in question.
- If the Smartplan account is not terminated before the free trial period expires, the amount will be charged for the coming month's subscription.
- An invoice will automatically be forwarded by email.
- When upgrading or downgrading a subscription, the new amount will automatically be withdrawn at the next billing date.
- Where Smartplan suspects the creation of several new accounts by the same Customer or under a new name, in order to avoid paying for a subscription, Smartplan reserves the right to block the account.
Cancellation and Refund
- The Customer can use Smartplan for 30 days without charge.
- Where Smartplan is terminated within 30 days, the Customer shall pay nothing.
- Where the Customer deletes his or her Smartplan account, withdrawals will come to an end, thus ensuring nothing is charged for the following month.
- It is the Customer's own responsibility to cancel and close an account with Smartplan. Smartplan does not regard it as a notice of termination to receive an email or letter. The Customer must delete the account via Smartplan, which terminates the subscription.
- Where the Customer has made prepayments for an extended period, the remaining balance is non-refundable.
- Where the Customer has unused text messages, the balance is non-refundable.
- As Smartplan delivery is digital there is no return or 14-day cancellation period. The service is delivered at the time of payment.
